We have been good tenants for 3 years, signed a 1 year lease , then a 6 month lease, and then went month to month. When presented with a month to month lease to sign, we refused. It didn't appear to give us anything, and the leasing company had raised our rent by an additional $50 when we went month to month. We gave our written 45 day notice to move out 5-31 with a move out, on or before 7-15. July 1 with rent check inform leasing company we would not be moving out until at the earliest in August and we would pay this month (July) and August as usual and keep them posted. Sent in rent August 1, heard today 8-22 that they have rented our place, sight unseen to be occupied 9-1. We are now close to closing on our house but can not vacate until Oct. 1. Leasing company says we are Holding over, and will have to pay double the rent on sept. 1 stating winter is coming and they will not be able to rent the place for six months and that they will lose the person that is slotted to move in on Sept 1. We have always been on time and no complaints from anyone. This is very messed up, we can not afford this! What can we do? Take them to court? small claims or civil. Two months rent is substantial - - - - HELP, PLEASE HELP!!!
