My lease expired December 2007 and I was month to month after that. On February 29th, 2008 I gave 30 day notice to the rental office. The property manager responded (in writing) stating they require 45 day notice and April 14th would be the last day. She went further (in writing) to say "If a 45 day notice isnt given, the remaining days will be taken out of my security deposit."
They refused to do a walk through with me present a few days after that.
Since April 14th was what I thought to be my last day, I I hired Elite Moving and Storage to come and take most of my belongings to my new residence on March 26th, however I did still have leave some property behind. Upon entering the property on April 3rd to clean and collect the remaining items, I discovered they had been moved, damaged or put in a bag I was using for trash. Some food was taken off of the refrigerator and placed onto the floor with cleaning products and old towels. The bathroom rugs and towels were put in an existing trash bag (which contained trash) with a plunger and cleaning products that were not closed completely. (I did take pictures)
I am very disturbed by the above actions and my friends and I walked it down to the dumpster, as it is now trash indeed.
I hadn't even returned my key yet. I wrote a letter to the property manager letting her know I feel I am entitled to my entire security deposit as an inconvience on April 4th (I feel I could hold them responsible for my property left behind, as well, but I did not press the issue)
Today, April 12th, I called to check on the status of my situation and she was very vague and arguementative. She stated she would need to get back to me later next week....but she has been avoiding me and will not confirm the date my lease officially expired.
My question is....since they required 45 day notice (and she responded stating she would take the remaining 15 days out of my security deposit if it was not paid)...wouldnt the apartment be mine until April 14th?
And with that being said...they shouldnt have gone to the unit until after the 14th?
Lastly...I have a feeling they are going to try to charge me for my belongings that were left behind and I had not cleaned yet....that would be totally wrong...right?
