I have 4 daughters and another one on the way. I am in an emergency situation. I need to move from where I am at so I went to see a 2 bdrm apt living rm dining rm etc with stove and refrig included I thought it would be handy for now until I got situated I told the landlord about me and my daughters and another one on the way
He said it wont be any problem. He asked me to give down the deposit of 450.00 so I gave it to him on Nov 17, 2005. He said to give him the first month rent on Dec 5, 2005 and he will give me the keys. I agreed. I just found out I am having a boy and I have a socialworker that told me that the law mandates 2 people per room.
I called the landlord and told him about me having a boy and that now I need a 4 bdrm apt. I asked if I could get get my security deposit and he refused because he turned other people away saying it was rented already.
I just want to know if i can get my deposit back or at least have only half of the 450.00. Please let me know. I am desperate. I need the money to find another place and also it was a one year lease starting Dec 1, 2005 but I havent even signed it yet.

In Ohio, there is no state law which controls how many people can stay at an apartment, but local ordinances often do speak to this issue. If there is a local ordinance which says that your family has too many people at the apartment, then your lease could be unenforceable because of illegality. You will want to speak with an attorney about your situation. If you don't have the money for an attorney, you might wish to try legal aid.

i am sorry i didnt understand really what you meant can you please explain it to me one more time what does local ordinance mean? and another question i had so if i move to a two bdrm apt being myself 4 girls and a newborn little boy and signed a leases can i get in trouble?

Laws that are passed by the Ohio Legislature are statutes. Laws that are passed by your local city government are Ordinances. While the state may not prohibit something, this does not mean that a local city government cannot step in and make something illegal.
For instance, there is nothing in the State law which forbids smoking in restaurants and bars. But the City of Columbus has passed an Ordinance banning smoking in restaurants and bars.
