View Full Version : Insurance claim Responsibility

I moved into a coworkers house he leases. It is 2 units; upper and lower. I am in the upper. We have no formal lease agreement; I just pay monthly. The problem is a week after I moved in, I noticed the bathroom sink drains incredibly slow, so I mentioned this to him and that was the end of it. Skip 3 months ahead to a week ago. Middle of the night I go to the bathroom, use the sink, then go back to sleep. 2 hours later i get a call from the guy downstairs about water everywhere. i get up and look and noticed that I apparently left the sink on at a slow stream where any normal sink would be no big deal. So we cleaned up, the owner decided to file a claim although there has been water damage before. Today, I get a letter from Insurance saying that I have to pay, but they don't give any amount. I also did not get renter's insurance. Is this something that I have fully responsible for when I told him about this problem and nothing was done? I think it should be something like 50/50. Please advise me of the best outcome for me. Sorry for such a long story, but thank you a lot to anyone who responds!

If you mentioned it to him then the responsibility would normally fall on him to repair the problem. Of course, not sure what your legal relationship is with him. Are you subleasing? Are you another tenant? Generally you should bring any problems to the attention of the landlord in writing.
