Ok, Ive written several times, now here is the conflict I am now facing, the landlord has sold the house, and has asked us to leave, with no proper form of eviction, the husband and I are separating, and as of yet, he has not found a place, however, I have, the problem is, I cannot move in until they have the painting done and so on. Now for the question that I have, who evicts us, present or past landlord, I feel that also he is harassing us by calling every day, or driving by, as so are the new owners of the home. I believe that in order to get him out and properly do so would be by eviction process, which to me is not just giving a written notice on plain paper, also there are severe electric problems that the landlord (past owner) will not take care of, I have no idea how to reach the new people to let them know of the problem. I have contacted the realitor but still no replys from them, what can I do??? Thanks for all the help!!
In Ohio, you can find out who owns the house by checking with your local county recorder's office. Just give them the address and they will tell you who owns it.
The owner of the place is the only one who can evict you. If the old owner files the case, you would have the defense to the action that he is not the real party in interest since he no longer has any right to possession now that his ownership interest in the residence has been extinguished by his sale to another person.
Further, the new owners will be bound by the lease agreement that the old owner had with you. If that has run out and you are now month to month, the new owners will still have to give you notice which comports with Ohio Revised Code Section 5321.17 (a plain English translation of which can be found in our FAQ section at http://www.ohiolandlordtenant.com/faq20.html)
If the owner of the place wants to evict you, then the owner will have to go through the statutory eviction process as outlined in Ohio Revised Code Section 1923.04. The failure to follow this statute in evicting you would likely be a violation of Ohio Revised Code Section 5321.15.
