Ok, let me first say I appreciate everything that this forum brings. I have used it for several years now. The 1st time I lost a case to get my security deposit back in 2003 when the landlord asked for me to basically remodel the place. I lost, he got to keep all the deposit, but got nothing else he asked for. Well after following much of the advice I have read on this forum. I yet found myself in the same boat about 4 months ago. The landlord when served notice of my intent to vacate (and not execute the option to extend the lease or purchase the condo) threatened to not refund my "down payment". Nothing in the lease agreement indicated it was a security deposit. Yet he withheld it all and asked for $2000 more after I only stayed there 4 months.
Well I decided to heed the advice, I got an attorney. I had pictures pre move in and move out. I had witness testimony. The guy asked to keep my $2k and wanted $4k more !!!! He had no witness,no depositions, no pictures, just computer generated letters from two companies that didn't even exist and his own testimony.
My attorney had a rebuttal for everything with photos, recordings, documents, witness testimony....and even got the guy to admit that he had made no effort at all to mitigate any of his claimed losses.
The judge takes 22 days to make a decision and awards him not only my $2000 but an additional $800 for attorney fees and bull sh*t cleaning costs. :confused:
I am sorry, but it is sickening to see how landlords continually get away with stealing peoples money. I think it is time for legislation to limit losses and sizes of security deposits in the state of ohio.
I rented for 10 years in the state of missouri and NOT ONE TIME did I lose my security deposit or have to pay after move out.
This states judicial system disgusts me. :mad:
