I am currently involved in litigation filed almost seven years after I moved out of an apartment.The first I knew of any claim for money was when a summons was received.That is some back-round, here is my problem. On the 17th of August 2000 which was the last month of my lease,I received an eviction notice for non payment of rent which I did pay after the notice. Before I received the notice I had not decided if I wanted to go to a month-to month which is provided for in my lease. After receiving the notice to vacate the premises, I sent the front office a letter dated August 18th letting them know I would obey their demand and leave at months end, which I did. But they are suing me for the month of September rent because I did not give them a 30 day notice. A 30 day notice was impossible under the circumstances. Any suggestion of a possible defense or any case law that might apply.

The only defense that I can think to use is that you were not sent an itemized list of damages within 30 days of moving out. You did leave a forwarding address as required by law, didn't you?
