Hello,

I have a question about my rights as a tenant and how I should approach the following issue...

I received a notice on my door which reads:

We need your help!
*** Apartments is beginning to fill up the 2007 Reservation List. Due to the unusually high volume of people that need housing for this upcoming August and Septemper it is imperative that we know your plans. If you will be staying with us for another year we are offering you a minimal increase of just $5 a month*. This increased rate is below our market value by as much as $75 per month!

Please contact me at the below email address or phone number.

By renewing your lease early (* by 2/28/07) you will not only be offered the lowest possible rate and be entered into a raffle to win 1/2 month free, but be guaranteed your spot here at *** Apartments for the upcoming year. If we do not hear from you by 2/28/07 we will not be able to guarantee your apartment for next year.

The staff at *** ApartmentsMy lease states that I am required to give them a 30 day notice. Can they legally change my 30 days from the end of my lease (which is August 31st) to the end of this month?!

What should I do about this?

I'd have to see your lease to give you any sort of informative reply. I assume your lease indicates that you must give 30 days notice of your intention to renew or not renew. The landlord usually has the same option. Here the landlord is just exercising that option. Nothing prohibits the landlord from saying it will not renew your lease earlier than 30 days before it ends. So, again without seeing your lease, I can only guess but my guess is that either party has the right to nonrenew prior to 30 days before the end of the lease.
