I recently moved to a Cleveland and only had a few days to find an apartment. I decided on a place primarly based on its price to the advertised square footage. I recently got curious on the acctual square footage after a friend of mine questioned its advertised size, so I measured the interior of the apartment. Depending on the definition of measured square footage used the apartment mearures 80-120 square feet smaller than advertised. I measured 817 sq ft giving the most maximizing definition. The leasing agent confirmed the approximate size of "almost 900 sq ft." and the advertisment used states 896 sq ft. as the "approximate dimension." I am curious if this is a material misreprsentation of a stated fact. I have read the Ohio Landlord Tenant Act and can not come to any conclusion. Any help on my question would be great. thank you

In my opinion, this would not be a material misrepresentation. Realtors do this all the time with homes for sale. You could use it as a means of negotiation less rent.
