View Full Version : evicting Sect. 8 tenant

I have a Sect. 8 tenant who is only 1/2 through her yrs. lease. She has 22 lease & rule violations, many of them are repeated violations (unregistered occupants, trash, flammable fluids near ignition sources, failure to do yard work, failure to report a crime on the property, etc.) All these things are spelled out in her lease (& the rules that are incorporated into it). I gave her a 3 day notice to vacate. Went to court to file eviction. Clerk said the magistrate would throw it out because I did not give 30 days notice to vacate. What do I do? Section 8 agreed to let her go.

Certain lease violations require 30 days' notice.

Violations of 5321.05 require a 30 day notice

Section 8 tenants also have other notification requirements. I remember a 10 day notice as well.

Every time I have had any problems with a Section 8 Tenant I have just called the director of our local Section 8 office and they send the tenant a letter and also talk with them about their non-compliance. If a section 8 tenant is evicted for cause the generally loose their section 8 eligibility if not for ever, at least for a period of time. Usually they shape up to keep their eligibility. You may want to try talking to the Section 8 office for help.
