Damages by negligence
Our apartment maintenance staff has been drilling holes in our floor through concrete to fix a water pipe leak. It was a search and solve mission starting near the hot water tank and went through several rooms. They put us in an extended stay hotel while they did this. The problem is that the place is now trashed. The dust from the concrete is everywhere their is a surface. Walls. Floor. Good Furniture. Mirrors and ceiling. The leather sofas are ruined and they were never properly covered , nor were they put back after they finished and put the carpet back down.
We are at are wits end with these people. This apartment has been rented since May 2005 and has had ants. Even this winter. They will not go away and they are clearly in the walls/foundation. We rarely can get apt management to call back and as they are not on site they have a "can't see em, don't need to listen" attitude towards us. They have sent out Ohio Exterminators twice and they use the same stuff I can get at Home Depot and leave. Ants are back in a couple days.
The disposal has broken twice and they tried to bill us for negligence. After relentless phone calls to them they finally removed the bill. Same with the shower drain, which was very very slow upon moving in. They came out, snaked, and billed.
It has been one thing after another. The A/C was out over the summer and then the dishwasher broke. It took them 3 months to come out and fix it. When they tried to hand the bill for that I handed it back saying not to bother.
We are frustrated beyond words here. WHat can we do about the damages to the furniture? Aren't they supposed to have cleaned up after themselves? They also trashed their own property and we are sure they will try and bill us for this. The carpet is muddy has cement chunks in it and the bathroom floor is scratched. Besides taking pictures to cover ourselves so we don't get charged, what recourse do we have? Can we ask for a discount in rent in addition to the damages? How do we get them to listen and respond?

As for the damages to your possessions, you will want to document this through pictures and get any receipts from your purchase of the items that you can in order to establish their value.
You should put all of your communications with the landlord in writing and keep copies in your file so that you can show a court your correspondence if you have to. Further, you should make a written demand to the landlord for the value of the ruined couches, basing it upon their negligence in working with the cement dust.
