We will be moving out of our rented house on September 30, 2006. That is the end of our lease. For almost 2 years now we have lived with a hole in our kitchen ceiling caused by a leaking bathtub. They came to fix the problem that started the leaking but never fixed the hole in the ceiling, and they never fixed the seals around the tub to prevent the water from causing more damage. We also reported to the landlord that the side porch, bottom stair was damaged due to all the raining in our area, and that needed to be fixed. In the beginning of this summer, I was outside and I noticed that there was a window in our bathroom, that i had never seen. Inside the bathroom , the shower was built to cover up the window. From the outside the whole window looks like it is covered in black mold. That would also explain why repeated cleaning of our bathtub, gets us like 1 day of clean, and then the black moldy stuff around where the caulk should be comes back. We have been living here for 3 years, although we have been late in the past with our rent, we've always paid it, including the late fees. Would it be that terrible to use our security deposit for the last months rent considering the conditions and others that i havent mentioned that we have had to live?? Please someone respond, I'm not sure what to do and I do not believe that these people (who are realators) will give us our security deposit back, especially since they haven't really done anything to fix these problems, when they arose. That' s why we are even considering this.
