Hello,

We had an open lease with our landlord. We told her in March '06 that we would be moving out in May '06. We have not received our security deposit. We called and she "found" holes in the door and she said she is working on getting an estimate. The holes were in the door when we moved in. Unfortunately, I didn't document the holes before we moved in. What can I do? What success can I have with he said, she said case? What can I do to force to move faster with estimate, etc?

Unfortunately, he said she says does not seem to work in court and if you were given the opertunity to document any damages and you did but overlooked the door, it would most likely tell me that you reported all visiable damages and the door has now become new damages. It should not cost to much even if the door needs replaced. cut your lost and be more carefull and more thoughough next time look at this way, You had to pay for your schooling. Sorry that is my opinion. I am noone, just deal with people daily.

according to ohio law after u move and give ur forwarding address do it by registered mail requeasting your deposit back she must repond within 30 days and if she doesnt respond then take the landlord to small claims court and ask for double damages we just went thru this with my daughters landloed and won double the security deposit back
