View Full Version : Tenant staying w/out lease or rent payment

We have a tenant that we have had on 3 month leases. We sent a new lease to be signed and started in August. We did not receive or the August rent and so called the tenant. She told us that she was waiting for us to call and told us she is moving. She's owes us August's rent, late charges for 3 months and about $300 in past due rent. According to her lease, she was suppose to give us 30 days notice - she did not. The problem now is that she is still in the house, has not paid us, and we do not have a current lease. (it ended in July) We are fine with her leaving, we just want to collect our money. Plus, we are worried about not getting a forwarding address. Her deposit does not cover all she owes us. What courses of action do we have available to us?

You may wish to file a court case for an eviction before she leaves. If not, you probably won't find her after she moves.

It seems that more and more dead beats are out there.
I gave a tennent 3 day notice and they told me they were moving anyways since they had not paid rent for September, Now we are in October.
Well anyways, after giving them the notice they brought a moving van in called me and told me "hope you are happy we are leaving" after three days and noticing no real action, I called them and then I was told that they changed their minds and I have to put them out.?
I guess I should not of trusted anyone that much, but it sounds like I need to file for the evicition as well. Or since they have moving truck ect.. can I call police and inform them they are there now illegally and was supose to be in the process of moving and I want to know what they intend with a policeman on hand?

A quick note. The police are generally useless to landlords in Ohio, because they are so limited law wise. As for the dead beats yes file eviction on them immediatly, they sound like typical dead beat looser tenants. I have dealt with enough of them myself. And the worst is with ohio's lousy court collection laws you probably won't get didly out of them money wise.
