(1) If a person was to be successful in his claims under ORC 4112.02, what damages are available? (2) Are the damages the same as under Title VII (3) What proof must be set forth to prove the damages? Thanks.

Generally, damages for back pay, lost fringe benefits, perhaps front pay, emotional distress damages, and perhaps punitive damages are available. To obtain these damages, first you must establish liability under your discrimination claim of the employer, then actual lost back pay and lost fringe benefits, that you suffered emotional distress, and to establish punitive damages - you must show that the employer acted with deliberate or reckless disregard for your rights in taking the actions that it took against you.
