I have a tenant that I gave a 30 day eviction notice to due to her breaking all of the rules of the lease. I was over doing repairs to the house and she was angry and assaulted me. I pressed charges and she ran. Now, I left a 3 day at her house. I haven't seen her since the assault but there are always people in the apartment and she is the only one on the lease. I noticed I have a broken window. After the 3 day, do I just go file with the courts? Is there anything else to do at this point? Can I get the people in trouble for staying when they are not on the lease?

If it is a violation of the lease, then you can also evict based on unauthorized occupants (if you include it on your three day notice).

If the tenant ran, and none of the occupants there were on the lease as tenant or occupant, then I would inform the visitors to leave immediatly and that if not they are tresspassing(mention broken window and ask if any can produce a working lock key.. probably not). If they leave change the locks, fix the window, and inform them that if they come back they will be trespassing. Call it the cheap eviction hence avoiding ohio's expensive eviction system which is pretty lousy. Do what you want, but I have even had a landlord I know tell a tenant he would pistol whip him, if he didn't get his dead beat butt out.. It worked for him that time.. Not real legal, but hey the laws for landlords suck wind.
