Hi. My husband and I are currently in a lease-with-option-to-buy contract. We paid first month's rent plus $1,500.00 security deposit. The security deposit and $350 of our rent was to go towards a down payment on the house once we went to buy it. The contract is good through April 2006. However, my husband and I were starting to think this house wasn't for us. The roof is filled with moss, the paint is peeling off the house to a point it's embarrassing to have anyone over, and the poles that support the porch roof keep falling down. Not only that, but one of the springs on the garage door snapped, and the pulley just missed my head and slammed into the garage wall. He also promised to get all of his stuff out of the shed, but he never did. He has a camper and a trailer sitting in our back yard. I was told we could charge him for storage, but I never got around to checking it out.
We then started getting water in the basement. He told us he NEVER got water, but the neighbors told us that wasn't true. He said he would price a sump pump, but then he changed his mind and said we would negotiate that when we bought the house. So now we have a room in the basement we can't use, the water bubbled up all the paint, and it ruined the carpet we paid for to put down there. It says in the contract that he wouldn't pay for any water damage, so I'm assuming he knew there was problems.
Okay, so now we found a house and we're going to buy it. I didn't tell my landlord yet, but I will give him 30 days notice as it states in the contract. I told him we were looking for another place to live as our gas budget went from $114 dollars per month to $355.00! We have plastic on everything, and we're still sitting around in our jackets. It's pretty bad when you look forward to going to work because it's warm there. My landlord is getting antsy, and I have a feeling he won't give us back our security deposit. I don't want to lose $1,500 when all we did was put money into this place.
Any suggestions?
