I am doing a lease with the option to purchase. There is a section in my lease that I do not understand: "this lease is subject to all valid sections of the Ohio Revised Code, which regulates the respective rights and obligations of landlords and tenants. Any provision herein contrary to said laws shall be of no force and effect. Any sections of the law which are contrary to the said provisions shall be substituted therefore."
There is another section in the lease that says that we (lessees) are repsonsible for maintaining the property (repair and/or replace) at our expense. Does this mean that the owner of the house isn't responsible for any repairs to the property?
There are two sections to the contract - the first pertaining to the lease, and the second pertaining to the option purchase. In the option purchase section it has a paragraph about purchasing the property in "as is" condition.
When I contacted the owner of the property about the repairs, she was offended and told me that the repairs were my responsibility and that we had agreed to purchase the property in "as is" condition. I told her that we are currently leasing the property and have not yet "optioned" to purchase the property.
She wouldn't budge on the repairs. Also, we had a bad storm recently and had a tree fall. Part of it is in our yard, and part of it is in our neighbor's yard (most of it). They are not happy and we are not sure what to do.
I have read the Ohio Revised Code and do not see anything that specifically applies to leasing with the option to purchase. I found something for the city of Cincinnati that actually spelled out my rights. The problem is that although I am in the same county, I don't exactly live within the city limits. The owner is saying that it doesn't apply.
Any advice?
