We have sent a "Notice to Initiate Forfeiture of Land Installment Contract" to our tenants. They still refuse to comply with the terms set in this notice. But, begged us to accept less than half of the past due money owed, with promises to pay up in full in the next 2wks., to let them stay. We said NO! In addition they have also let the homeowners insurance lapse for almost 4 months now, which is a breach of our contract also. We have not heard from them since their last call 2 days after they were served with the notice. They have 10 days to comply, if they do not then it states they have 3 days to vacate the property. We anticipate problems with these people in refusing to leave the property and children are in the home. My question is, can/should we call the police to enforce the terms of the notice sent to them if they do not comply? Thank You.

In Ohio, if the tenant has been in the property for less than three years, you can clear them out upon breach of the terms of the agreement via an eviction. If they have been in the property for more than three years, then you will have to use a foreclosure proceeding.

If this problem arises in central Ohio and you wish to speak with an attorney about handling the eviction, you can contact me by clicking on my name above. If you are out of the central ohio area and you want an attorney, you can either call your local bar ***ociation for a referral, or call any large apartment complex and ask them who does their evictions.
