View Full Version : Rent increase in middle of lease.

I have been living in the same apartment complex for the past two years. This past August, my landlord sold the property to an investment company, the company then in turn transferred ownsership to a private individual. Prior to the actual sale and transfer in ownsership, I signed another lease that is set to expire June 30, 2006. I was told that my lease would be transferred over to the new landlord, therefore I would not experience an increase in rent. Upon taking over the complex, the new landlord increased the rent by $45 - 50 for new tenants. However, up until now I have been paying the amount that is on my lease.

Well recently my landlord sent me a letter dated April 4 that as of May 1 he would be increasing my rent by $45 due to the increasing real estate taxes. I called him to tell him that I have a lease agreement, and he said that "since the lease was not signed with him, then he doesn't have to abide by it." I know for a fact that the previous lanlord, made stipulations in the sale of the complex, prohibiting the new owner from raising the rent if the tenant has a lease. I know that I only have a couple of months left. I was thinking of continuing paying my lease rent and once I transfer over to month to month begin paying the higher rent. Is that appropriate? Or even if he does decide to raise the rent once I become month to month, would he still be required to send me written notification by May 1 for the increase in rent to be effective July 1.

Thoughts would be helpful.

New landlord must abide by old lease even though he didn't sign it until that lease expires.
