Hello,
My first post here so please forgive if it is not in the correct area.

I was wondering waht the land lord has to disclose in requards to utility useage.

I ask because I have reciently had confirmed that there are somethings that I was not informed of when I moved in here. Right now as i live in a rural area that has a well the pump is run off my electricity not a problem knew that part But what I didnt know is that I would be paying for the electricity for the water paump to pump water to 4 possibly 5 other units on the property. The other 4 units are 2 or 3 mobile homes, and a connected efficany. the last being a barn which i pay extra rent for useage so not really a big deal on that one. BUt what I didnt know about the barn is that I pay also for the 'heating' of one section that is used for storage of someone elses property.
what I also didnt kow is that I would be supplying the hot water to the efficancy as i was told out right that the efficancy had all its own systems which i assumed included hot water and heat. While it has electric base board heating my furnace also supplies heat there so i guess the tenant of that doesnt have to turn on their electric heat.
I noticed a large increas of both my electric and gas bills at some points over the last 4 1/2 yrs I have lived ther but didnt put them together until i sat and connected them it when these units were occupied. I figured that with the increases of the gas company in rates tht was probably it BUt dispite me turning down my heat in winter to near not safe levels my bill continued to incread not stay the same. And there is a dramatic increase in electricity bills ie did average when not all units occupied bout 75-100$ per month depending on season. But it jumps to averaging 225$ per month when units occupied.
Now when I confronted land lord with this his spouse replied 'we did nothing illegal and you will just have ot live with it."
Is the land lords spouse correct that they did not have to disclose this and given me options like agreeing to pay this increase when units are occupied, given the choice to negoiate another arrangement, or just out right not rent this place.
My husband would really like to sue them for financial heardship as these bills have at times place this upon us. Do we have a leg legally to stand on? If so what is the statute number so I can present it to mrs ' we did nothing illegal." We are moving shortly before the end of the month.
there are also some questions on how the septic system is set up on this property as well but I think that is a local not state regulation.

But the landlord can't charge you for utilities used by other tenants. You could sue the landlord for breach of contract. The problem is how do you determine how much in utilities you used versus everyone else. In other words, you must prove how much you were damaged. At best, you can only estimate that but it's still worth taking to court. Make sure when you move out, that you don't give the landlord any reason to keep your security deposit too.
