We are currently on a 6 month lease that's expiring. In one of our conversations with the rental office , we were told in the p***ing that we are paying less and that there would be a rent increase when we renew. However we have not gotten any notice for the rent increase so far. Can they increase the rent without giving any notice ? If they can't , and they won't give us a lease what can we do ?

In Ohio, once the lease agreement expires, the landlord or the tenant can agree to as much of a rental increase or decrease as they want. If the landlord is asking for too much, then there are a lot of empty apartments out there which await your arrival.

If you do not sign a new lease, but continue to pay rent on the place, and if the landlord accepts this rent without protest, then you will be seen by Ohio Courts as a month to month tenant. Whenever you do leave, you will want to take steps to make sure that you get your security deposit back. Ohio Revised Code Section 5321.16 allows for you to get double damages and attorneys fees if you can show a court that the landlord has wrongfully withheld your deposit for more than 30 days.
