View Full Version : Non paying tenant and repairs

I have a month to month tenant that has not paid rent in 2-1/2 months. I served her with a 3 day notice, and she is still in the property. I filed an eviction and the cout date is set for Aug 5th. Late last night I get a call saying that there are some plumbing issues that are causing the celing below to sag and could possibly collapse. I told her to shut the water off to the toliet and I would send someone over A.S.A.P. My question is by law do I have to make these repairs while she is still in the property? or could I just not make the repairs? essentially giving her a reson to leave early before she is evicted because the house does not have a working bathroom.

Chances are she is trying to create a defense to the eviction action.

Well, I went to court yesterday and she had no defense. Judge gave her 7 days to leave. Now my question is can I legally use here security deposit to help cover some of the $2200.00 in rent she owes me?:mad:
