I had rented my apartment for 2 yrs, and the lease was due to end on 3/31/06. On 10/31/05, I came home from a weeks vacation to a severe plumbing/water leak from the upstairs tenant into my master bathroom. It took over a month for the maintenace guys to come to slap some "kilz" on the walls. Mold had invaded the bathroom and destroyed the sink cabinet. Despite repeated requests to repair the bathroom, I was ignored. On 2/3/06, I gave written notification of my intent to vacate on 3/31/06. After a loud 20 minute discussion, the manager of the complex agreed to reduce my March rent "due to issues w/the master bath". She refused to let me out of my lease early.

She was in a terrible rush to get me to leave the apt a week later, and I learned from the maintenance guys that she had rented it to another person beginning on 2/28/06. I was not given any notice, and was still in the process of moving out. Today (2/26/06) I went over to the apt, and found that the unit had been entered w/o my knowledge or consent. It had also been recarpeted. I feel this was a violation of the contract.

My concern is that the manager of the complex will try to withhold my security deposit due to carpet problems. I don't feel this should be the case, since I was never informed that the carpet needed replaced, or had given authorization for entry. I am still receiving mail at that address, as well as paying the utilities, and had paid the rent through the end of February. What do you think about the situation?

It sounds like you have several issues.

1 - To get the landlord to make repairs follow the procedure outlined here -

2 - Unless you agreed to terminate the lease early in a written addendum to the lease, then technically the apartment is yours until the old lease expires, but it sounds like you are just glad to be out of there.
