We moved into our apartment 2 months ago. We spoke with an outside agent, who we went thru with all of the paper work. I was out of town prior to and during the move, while my fiancee filled out the paper work and moved us in. Nothing was ever mentioned verbally about a no pet policy. And we didnt think to ask. Until I read over our lease agreement a month later and found it. I now know that our landlord knows we have a cat, and I am very worried about her next steps. She has not yet approached me. But I am afraid of being evicted. It is my fault for not being there and reading the fine print- however I was dealing with a family crisis for quite some time. Should I approach her first and try to work something out (we do not want to give up our cat) I can offer more money, etc. or does she have to right to just evict us? If we are asked to leave what kind of damage can this do to our credit. how much trouble are we in! any advice welcome thanks

- In Ohio, upon a breach of the lease agreement, the landlord can institute an eviction. But for most landlords, unrented property is not very desirable.
As such, were you to offer the landlord an additional amount as security against any damage that the pet might do, the landlord might find this acceptable.

But if not, the landlord will have the right to ask you to leave.

I live in a pet free building and have horrid allergies. Recently, someone moved in next to me and has a cat in violation of the policy. I have been having horrid allergy symptoms. In addition, my neighbor spilled a long trail of used cat litter from her door to the dumpster, and it keeps getting tracked into the building, and it makes my allergies worse. Although I understand you plight, keep in mind that some of us live in pet free buildings for a reason.

I would hate to see my neighbor evicted, but I told my landlord that the cat needs to go.

PS- Due to my allergies, and the fact that I live in a pet free building, can I legally break my lease if my landlord doesn't get my neighbor to get rid of the cat? It is clearly on the lease that there are no pets allowed in the building. I would not have signed a lease if I had known there would be pets in the building. Thanks.

In Ohio, if your lease guarantees you the right to live in a pet free building, then upon a violation of the lease by the landlord, you can treat it just as you would a failure to fix a defective condition around the apartment.
