We have fallen behind on rent in the past, and my landlord never filed for eviction until the second month was past due. I was told today when I attempted to pay rent (so I would only be one month behind) that eviction had already been filed and that I had received a 3-day notice. I have not received that notice and told them so. They said that they cannot accept any rent until I pay the two months plus attorney fees. Is this legal?

If the landlord has accepted rent late in the past without protest, then this may work an estoppel upon the landlord from evicting you as an Ohio court might find that the landlord has waived his right to receive rent in strict compliance with the terms of the lease agreement.
