My cousin is going to move into a new apartment and out of her old one. She wants to move in the middle of October and only pay 1/2 a months rent to both. The new landlord is accepting, but the old landlord says that she has to pay the full months rent for October. She gave them notice in August of her intentions. I thought the law says 30 days, period. Does it matter that it's the middle of the month? She pays her rent on the 1st of every month and has been a model tenant. Please help! She'll be out $325 dollars!

Ohio Revised Code Section 5321.17 still controls the situation. If the rent is paid on the first of each month during the month to month tenancy, then Ohio Courts are most likely going to find that the rental period starts at the first of the month and ends at the end of the month for the calculation of the required 30 days notice.
