I recently moved into a new apartment complex that, according to the landlord, is rented to "young professionals and grad students." Believing this, I agreed to pay the relatively high rent and signed the lease.
After a few nights there, I realized that I had made a big mistake. The guys that live above me have two big dogs that go absolutely nuts at all hours of the day, causing the entire complex to shake. I have had pictures jar off the walls and protective covers to the fire sprinklers on the ceiling fall off due to these dogs…
But the worst part is the late night behavior of the tenants. Almost on a daily basis, I am awoken between the hours of 2:00 A.M. and 4:00 A.M. by loud stomping noises, shouting, and banging, which persist for up to an hour.
I have expressed my frustration, twice, to the landlord, who said she would have a talk with the tenants in question. The problem still exists.
I understand that many people do not have the same lifestyle and schedule that I have, but I should be able to sleep, relatively undisturbed, in my own home during these hours.
Do I have any legal rights that would justify a lease termination?
